
(香港,2025年11 月26日)香港工程師學會(下稱「學會」)早前獲香港特別行政區政府發展局委任成為《建造業付款保障條例》(第652章)(「《條例》」)審裁員提名團體,負責提名具資格及獨立的審裁員,處理相關條例下產生的付款爭議。
《條例》旨在改善建造業存在已久的付款問題,禁止把「先收款、後付款」等不公平付款條款寫進合約,並設立審裁機制,提供一個迅速、具成本效益及有約束力的中期付款爭議解決程序。《條例》於今年8月底已全面實施,申索方可根據《條例》向提名團體提請審裁,提名團體會委任獨立第三方的審裁員裁定付款爭議。
學會會長周健德工程師表示:「學會獲認可為《條例》下的審裁員提名團體,實屬榮幸。這充分體現出學會在促進香港建造業爭議解決機制方面的專業精神及長期承擔。學會的建造事務爭端解決委員會已統籌並設立『審裁員』及『高級審裁員』名單,以支援有關審裁員名冊安排,確保承建商、分包商、顧問及供應商能獲得其完成工程或提供服務的合理報酬,推動公平高效的付款文化。」
學會亦已制訂《香港工程師學會審裁規則》及建議標準條款,致力為業界提供一個清晰、快捷且易於使用的審裁程序。

(26 November 2025, Hong Kong) The Hong Kong Institution of Engineers (HKIE) was earlier appointed by the Development Bureau of the Government of the Hong Kong Special Administrative Region as a nominating body under the Security of Payment Ordinance (Cap. 652) (the “Ordinance”). The HKIE is responsible for nominating qualified and independent adjudicators to handle payment disputes arising under the Ordinance.
The Ordinance aims to address the long-standing payment issues in the construction industry by prohibiting unfair payment terms such as “pay when paid” clauses in contracts. It also establishes an adjudication mechanism to provide a speedy, cost-effective, and binding interim process for resolving payment disputes. The Ordinance was fully implemented at the end of August this year. Under its provisions, a claimant may apply for adjudication through a nominating body, which will appoint an independent third-party adjudicator to determine the payment dispute.
Ir Alice Chow, President of the HKIE, stated, “The HKIE is honoured to be recognised as a nominating body under the Ordinance. This recognition reflects the Institution’s long-standing commitment to professionalism and its role in strengthening dispute resolution mechanisms within Hong Kong’s construction industry. The Institution’s Construction Dispute Resolution Committee, supported by a dedicated Panel of Adjudicators and Senior Adjudicators, will oversee the nomination arrangements to promote fair and effective payment practices, ensuring contractors, subcontractors, consultants, and suppliers are compensated for work performed or services rendered.”
The HKIE has developed the Adjudication Rules and a recommended model clause, aiming to facilitate a clear, efficient and user-friendly adjudication process.
